Collaboration contract
By completing this form, you agree to the terms of this agreement. This is a contract between the above referenced Client Name, known for the purposes of this Agreement as "CLIENT," and Kate Whyte Photography, known for the purposes of this Agreement as PHOTOGRAPHER. CLIENT and PHOTOGRAPHER agree to the following:
A Trade of Service session occurs when there is no exchange of money by mutual agreement of all parties. Trade of Service sessions are intended to provide a portfolio benefit for all parties involved and. Imagery must not be traded or altered in any way, which includes cropping, removal of team credits (watermarks) and/or application of electronic filter effects. Imagery is to be preserved in its original state at time of delivery.
Images are not to be sold or bartered in any manner whatsoever and are to be protected from third parties in doing the same or using imagery to promote/advertise their wares or services. Imagery that is wished to be used in this manner requires another, separate, limited use agreement that must be negotiated with all parties involved in its making.
It is agreed that imagery from a Trade of Service session is subject to public posting on the internet as long as that the said imagery is not being used in a slanderous or derogatory manner of any kind.
When imagery is on public or private display, or being displayed or posted on any internet forums, it is imperative that all team members of who were used in its (the images) creation be credited for their contributions. Accreditation must be made in a manner which is clearly visible to any person that may be viewing the image while it is being displayed.
The photographer will determine what images will be released and what editing (if any) will be performed. Final output will consist of high resolution imagery, as well as images that are sized and ready for use on websites. There is no guarantee on number of images from said type sessions although typically between 3-5 photos will be edited. Copyright is retained by the photographer and this clause specifies the limited rights granted to all other parties to the Agreement.
If any party requires prints, size of print needs to be relayed to the photographer before date of session. These prints will be produced by the photographer and subsequently sold to the party requesting, at a mutually agreed to price.
